Terms of Service

Agreement and Operator

These Terms of Service are an agreement between you and Zubri, the operator of the Zubri mobile application and related service. By accessing or using Zubri, you accept these Terms. If you do not accept them, do not use the service.

Our Privacy Policy explains how personal data is handled. Please read it alongside these Terms.

Eligibility

You must be at least 13 years old to use Zubri. If you are below the age of legal adulthood where you live, you must have a parent or legal guardian's permission to use the service. You are responsible for complying with laws that apply to your use, including laws concerning alcoholic beverages where relevant.

The Service and License

Zubri helps home cocktail and mocktail makers catalog ice sphere molds, record freezing batches and pour observations, compare results, and review calculated experiment summaries across their own records. Features and availability may change as described in these Terms.

Subject to your compliance with these Terms, Zubri grants you a limited, non-exclusive, non-transferable, revocable license to use the app for personal, non-commercial purposes on Apple-branded devices you own or control, as permitted by the Apple App Store Usage Rules. The app is licensed, not sold. No other rights are granted.

Acceptable Use

You must not:

• Reverse engineer, decompile, copy, or modify the app except where applicable law expressly permits it.
• Resell, sublicense, transfer, or commercially exploit the app, Coins, or access to the service.
• Attack, overload, probe, or bypass the security or access controls of the app or its purchase systems.
• Upload unlawful or infringing material, violate another person's rights, or use the service for unlawful purposes.
• Harass, threaten, or impersonate another person, including in communications with Zubri support.
• Interfere with the app's operation or attempt to manipulate purchase fulfillment or Coin balances.

Your Content

You retain your rights in the photos, notes, measurements, and other content you provide. Your experiment archive is stored locally on your device and is used by the app to provide the features you request. You are responsible for having the rights to add that content and for the accuracy of the information you enter.

Purchases

This app does not offer any subscription, recurring payment, or auto-renewing service. All purchases are one-time consumable in-app purchases.

Zubri may offer Coins through Apple's in-app purchase system. Coins can be used to unlock advanced experiment reports created from your saved comparison records. The app displays the applicable Coin cost before each unlock. Basic mold, batch, observation, and comparison features remain available without purchasing a report. Coins are for use within Zubri, have no cash value, and cannot be transferred between users. Because Coins are consumable and the balance is stored locally, deleting app data or uninstalling the app may remove unused Coins and consumable purchases may not be restorable. Apple processes payments, and refunds are handled under applicable App Store policies and law. Contact Apple for payment or refund requests; contact Zubri for questions about your in-app Coin balance.

Intellectual Property and Copyright Complaints

Zubri and its licensors retain all rights in the app, its software, design, text, and other materials they provide, except for your content and rights expressly granted to you in these Terms. You may not use Zubri's name or materials beyond the license above without permission.

If you believe material in Zubri infringes your copyright, email Zubri@gmail.com with your name and authority to act, identification of the protected work, the location of the allegedly infringing material, your contact details, a good-faith statement that the use is unauthorized, and your physical or electronic signature. We will review sufficiently detailed notices and take action where appropriate.

Third-Party Services

Zubri uses Apple for app distribution and in-app payments. Apple's services are governed by its own terms and policies. To the extent permitted by law, Zubri is not responsible for Apple's independent operation or availability. This does not remove responsibilities that applicable law places on Zubri.

Termination

We may discontinue or restrict app features if you materially breach these Terms, misuse the service, or if required by law. Where practical, we will give notice and an opportunity to address the issue. You may stop using Zubri and uninstall the app at any time.

On termination, your license ends. Sections on content rights and responsibility, purchases already made, intellectual property, disclaimers, liability, indemnification, disputes, Apple terms, and general provisions survive to the extent needed to give them effect.

Disclaimers

To the maximum extent permitted by applicable law, Zubri is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, uninterrupted availability, and non-infringement. We do not guarantee a particular ice sphere, freezing result, or drink outcome. Nothing in this section limits rights that cannot lawfully be excluded.

Limitation of Liability

To the maximum extent permitted by applicable law, Zubri is not liable for indirect, incidental, special, consequential, or punitive losses, including lost profits or data, arising from the service. To that same extent, Zubri's aggregate liability for claims relating to the service will not exceed the greater of the amount you paid to Zubri through the app during the 12 months before the event giving rise to the claim or US $50. These limits do not apply where prohibited by law and do not affect mandatory consumer rights, including remedies for harm that cannot lawfully be limited.

Indemnification

To the extent permitted by applicable law, you will indemnify Zubri against third-party claims, damages, and reasonable costs arising from your material breach of these Terms, unlawful use of the service, or infringement of another person's rights by content you submit. This obligation does not apply to the extent a claim is caused by Zubri's own acts or omissions.

Governing Law and Disputes

These Terms are governed by the law applicable to the dispute under the conflict-of-law rules of a court with jurisdiction. Before filing a claim, please email Zubri@gmail.com describing the dispute. We will try in good faith to resolve it with you within 30 days after receiving your notice. If it remains unresolved, either party may bring the claim before a court of competent jurisdiction.

Nothing in these Terms deprives you of mandatory consumer protections or the right to bring a claim in a court that applicable law makes available to you, including where you habitually reside.

Apple App Store Terms

If you obtained Zubri through Apple's App Store, the following additional terms apply:

• These Terms are between you and Zubri only, not Apple. Zubri, not Apple, is responsible for the app and its content.
• Apple has no obligation to provide maintenance or support for Zubri.
• If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price you paid for the app, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the app; Zubri is responsible for other claims, losses, or costs arising from a failure to conform to a warranty.
• Zubri, not Apple, is responsible for addressing claims about the app or your use of it, including product liability, failure to comply with legal or regulatory requirements, and consumer protection claims.
• Zubri, not Apple, is responsible for investigating, defending, settling, and discharging third-party claims that the app or your use of it infringes intellectual property rights.
• You represent that you are not located in a country subject to a U.S. government embargo and are not listed on a U.S. government prohibited or restricted-party list.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you after your acceptance.

Changes to These Terms

We may update these Terms as the service or applicable requirements change. We will change the Last updated date above when we do. For material changes, we will provide notice in the app before they take effect. Continued use after the effective date of updated Terms means you accept them; if you do not agree, stop using Zubri and uninstall the app.

General

If a provision of these Terms is unenforceable, the remainder remains effective. These Terms and the Privacy Policy constitute the entire agreement about your use of Zubri, except for terms that applicable law requires. A failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; Zubri may assign them as part of a lawful transfer of the service, subject to your rights under applicable law.
